Course Description:
A study of the procurement and contracting process with emphasis on the organization, policy formulation, procedures, and administration of purchasing activities and functions.  Pre-requisite:  MG260.  3:0:3

Educational Philosophy:
The facilitator's educational philosophy is one of active participation between the facilitator and the students based on readings, lectures, discussions, and examinations.  The facilitator will encourage each student to express their ideas and demonstrate their knowledge and understanding of the subject matter.

Learning Outcomes:
  Core Learning Outcomes

  1. Analyze the role of legal council in an organization. The student should include a discussion of corporate, and outside legal services, alternate dispute resolution, mediation, and arbitration
  2. Define an agent and principle; include a description of the duties and liabilities of each.
  3. Discuss the Uniform Commercial Code (UCC). The student should explain its origin and use.
  4. Explain offers and acceptance in relation to contracting. Include the essentials of a purchase contract.
  5. Analyze delivery, acceptance, and payment as related to contracting.
  6. Discuss the Convention on the International Sale of Goods. The student should explain its origin and use to include its relationship to the UCC.

In addition to reading text materials prior to discussion in meetings and adequate attendance, requirements for successfully completing the course are as follows:

  • EXAMINATIONS:  Four (4) examinations will be given at appropriate course milestones as indicated in the course outline.

EXAMS:  Exams 1-3 will cover specific sections of the text.  Exam 4 will be a comprehensive Final Exam.  Exams will be given every two weeks, and will be worth 50 points each.  Exams will contain Multiple Choice, True/False and essay questions.

Final numerical rating will be the calculated based on the following point totals for each activity:

 

EXAM 1     50 points

EXAM 2     50 points

EXAM 3     50 points

FINAL       50 points

 
Each student will be graded on academic achievement and letter grades assigned based on the following scale:

 

A          186 – 200          93-100%

B          174 – 185          87-92%

C          160 – 173          80-86%

D          146 – 159          73-79%

F          145 or lower       72% or lower

All final exams will be comprehensive and will be closed book and closed notes.  If calculators are allowed, they will not be multifunctional electronic devices that include features such as: phones, cameras, instant messaging, pagers, and so forth.  Electronic Computers will not be allowed on final exams unless an exception is made by the Associate Dean.

Late Submission of Course Materials:
Late submission of material that has instructor approval will not recieve a penalty. Late submission of material that does not have instructor approval will be turned in no later than the next class session.  Non-approved late submissions recieved by the next class session will be reduced by one letter grade.  All others will not be accepted. Examinations may be made up provided the student has made arrangements with the instructor.  If no arrangements have been made, a grade of zero (0) will be assessed.

Classroom Rules of Conduct:
Professional conduct is expected by all students at all times, as well as tolerance and acceptance of other ideas and beliefs. A credible level of effort appropriate to the course material is expected.  Although this will vary from student to student due to work or personal events, it is the responsiblity of the student to be adequately prepared for all class sessions.  Students are expected to communicate with the instructor regarding absences, perceived deficiencies in coursework performance, etc. Park University policies regarding academic honesty/plagiarism will be strictly enforced.  Any indication of cheating or plagiarism on tests, examinations, papers, or other course assignments will not be tolerated.  Plagiarism is the appropriation or imitation of the language or ideas of another person and presenting them as their own work, and sometimes occurs through carelessness or ignorance.  Students who are uncertain about proper documentation of sources should consult the instructor. Absences:  The instructor may excuse absences for valid reasons, but missed work must be made up within the term of enrollment.  What determines an excused absence other than TAD or medical reason is up to the instructor's discretion.  THREE  unexcused absences will result in a grade of "F."  This is the official Park University policy.  Please note that for an absence to be an officially excused absence, (1) the instructor must agree and (2) the student must provide documentation.

Academic Honesty:
Academic integrity is the foundation of the academic community. Plagiarism:
Plagiarism involves the use of quotations without quotation marks, the use of quotations without indication of the source, the use of another's idea without acknowledging the source, the submission of a paper, laboratory report, project, or class assignment (any portion of such) prepared by another person, or incorrect paraphrasing. Attendance Policy:
Instructors are required to maintain attendance records and to report absences via the online attendance reporting system.

  1. The instructor may excuse absences for valid reasons, but missed work must be made up within the semester/term of enrollment.
  2. Work missed through unexcused absences must also be made up within the semester/term of enrollment, but unexcused absences may carry further penalties.
  3. In the event of two consecutive weeks of unexcused absences in a semester/term of enrollment, the student will be administratively withdrawn, resulting in a grade of "W".
  4. A "Contract for Incomplete" will not be issued to a student who has unexcused or excessive absences recorded for a course.
  5. Students receiving Military Tuition Assistance or Veterans Administration educational benefits must not exceed three unexcused absences in the semester/term of enrollment. Excessive absences will be reported to the appropriate agency and may result in a monetary penalty to the student.
  6. Report of a "F" grade (attendance or academic) resulting from excessive absence for those students who are receiving financial assistance from agencies not mentioned in item 5 above will be reported to the appropriate agency.
